Toys HS Code — Dolls, Puzzles, Games & CPSIA Compliance

Quick Answer

Most toys: HS 9503.00. Video games: 9504.50. Both 0% US base duty. Section 301 adds 7.5% for China.

Most toys classify under a single HS code — 9503.00 — and enter the US duty-free. That sounds simple until you realize the compliance side is where it gets expensive. CPSIA testing, Children's Product Certificate, lead and phthalate limits, small parts testing. The duty is $0 but the compliance cost can be $2,000–$5,000 per SKU.

The catch-all: HS 9503.00

HS 9503.00 covers: tricycles, scooters, pedal cars, dolls, stuffed animals, puzzles, construction sets, scale models, toy musical instruments, toy vehicles, and other toys. It absorbed several former subheadings in the 2022 HS revision.

US duty: 0%. EU: 4.5%. Canada: 0%. UK: 0%. The US and several other countries zero-rate toys — it's one of the few consumer categories where duty is genuinely not a cost factor.

What's NOT 9503.00

Not everything a child plays with is a 'toy' under customs classification.

  • 9504.50 — Video game consoles and machines (PlayStation, Switch, etc.). US duty: 0%.
  • 9504.40 — Playing cards. US duty: 0%.
  • 9504.90 — Board games, party supplies. US duty: 0%.
  • 9506.* — Sports equipment (balls, exercise equipment). These are NOT toys and have their own headings with varying duty rates.
  • 8519/8518 — Electronic music players, speakers. A Bluetooth speaker shaped like a dinosaur is still a speaker, not a toy.
  • 9503.00 specifically excludes: items that are primarily functional (a children's backpack is 4202, not 9503), sporting goods, and electronic devices.

CPSIA compliance — the real cost

Every children's product (designed for 12 and under) entering the US must comply with CPSIA. For toys, this means:

  • Third-party testing at a CPSC-accepted lab for: lead in paint (≤90 ppm), lead in substrate (≤100 ppm), phthalates (8 restricted types), small parts (ASTM F963), sharp edges, flammability.
  • Children's Product Certificate (CPC) — you issue this yourself based on the test report. It must reference the test lab, test report number, and applicable standards.
  • Permanent tracking label — every toy must have a permanent label with: manufacturer, production date or batch, and location of manufacture.
  • Age grading — CPSC requires age labels ('Not for children under 3' etc.) based on the intended age group. Incorrect age grading is a recall trigger.

Testing costs and timeline

Typical CPSC-accredited lab testing for a toy: $1,500–$4,000 per SKU depending on components and materials. Multi-material toys cost more (each material needs lead testing). Timeframe: 2–4 weeks.

Testing is per-product, not per-shipment. Once you have a valid test report, it covers all shipments of that SKU until you change the design, materials, or manufacturer. Re-testing is required if any of those change.

Frequently asked questions

Do I need CPSIA testing for pet toys?
No. CPSIA applies only to products designed for children 12 and under. Pet toys are not covered. But if a pet toy could be mistaken for a children's toy (shape, marketing), CPSC may scrutinize it.
What about adult collectibles (Funko Pops, model kits)?
If marked 'for ages 14+' or 'adult collectible' and genuinely designed for adults, CPSIA doesn't apply. But if the product appeals to and is marketed to children, CPSC may require testing regardless of your age label.
Are toy imports from China subject to Section 301?
HS 9503.00 is currently on the Section 301 list at 7.5% for China-origin goods. So even though base duty is 0%, Chinese toys face 7.5% additional duty. This has accelerated sourcing shifts to Vietnam and India.
